Terms of Use
Last updated October 28, 2026
These Terms of Use ("Terms") are an agreement between Trading Card Photo Booth ("we," "us" or "our") and the booth company that uses the Trading Card Photo Booth web app at app.tradingcardphotobooth.com and its related pages, and our booth app for iPad (together, the "Service"). In these Terms, "you" and "Operator" mean that booth company and the owners and staff who use the Service on its behalf.
Guests who use an Operator's booth at an event are covered by the short Guest Terms in Section 18.
1. Accepting these Terms
By signing in to or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. If you use the Service for a company, you confirm that you have authority to accept these Terms for it.
2. Who may use the Service
The Service is for business use by booth companies. Account holders must be at least 18 years old. Guests, including children, may use a booth at an Operator's event, but they do not have accounts.
3. Accounts
- Accounts are by invitation. An owner can invite staff and choose whether each person is an owner or staff.
- Keep access to your email account secure, since sign-in codes are sent there, and do not share sign-in codes.
- You are responsible for everything done under your company's account, including by the staff you invite. Remove people who should no longer have access.
- Tell us right away at larson_e@ymail.com if you think someone has used your account without permission.
4. Your license to use the Service
While you follow these Terms, we give you a limited, non-exclusive, non-transferable, revocable license to use the Service to run trading card photo booths for your business. This includes installing and using our booth app on iPads you control.
5. Your responsibilities
- Lawful use. Use the Service only in ways that follow the laws that apply to you and your events.
- Notice and consent. You decide what to collect from guests. You are responsible for telling guests and their parents or guardians what you collect and how you use it, and for getting any consent the law requires before you collect it. That includes verifiable parental consent under the Children's Online Privacy Protection Act (COPPA) before collecting personal information from a child under 13, and any consent or notice that state law requires.
- Accurate information. Keep your account, company and event information accurate.
- Your content. You are responsible for the logos, card art, photos and other content you upload or collect, and for having the rights to use it.
- Your equipment. You are responsible for your iPads, printers, paper and internet connection, and for keeping your iPads secure at events.
6. Acceptable use
You must not, and must not let anyone else:
- Upload or create content that is unlawful, harmful, harassing, hateful, sexually explicit or otherwise inappropriate for events with children.
- Upload logos, artwork or other material you do not have the right to use, including team, league or brand marks used without permission.
- Upload or collect anyone's personal information without the right to do so.
- Copy, modify, reverse engineer, decompile or try to extract the source code of the Service, except where the law expressly allows it.
- Scrape the Service, use bots to access it, or put an unreasonable load on it.
- Try to get around security features, reach another company's data, or test the Service for weaknesses without our written permission.
- Resell, rent or sublicense the Service, or use it to build a competing product.
7. Ownership
- Your content. You own the logos, card art, card designs, photos and guest information in your account ("Your Content"). You give us permission to host, store, copy, process and display Your Content only as needed to provide, secure and support the Service for you.
- Our Service. We own the Service, including its software, built-in card styles and designs, and everything we provide other than Your Content. These Terms do not give you any ownership of it.
- Feedback. If you send us ideas or suggestions, we may use them freely without any obligation to you.
8. Fees
There are no fees for the Service today. Any fees in the future will be as agreed with you or as shown when you sign up, and we will not charge you without telling you first.
9. Changes to the Service and availability
We are always improving the Service and may add, change or remove features. Some features may be labeled early access or beta; they may change or stop working and are provided as is. We work to keep the Service running, but we do not guarantee that it will always be available or free of errors, and it may be interrupted for maintenance, updates or problems outside our control.
10. Data and privacy
- Our Privacy Policy explains how we handle information, and it is part of these Terms.
- We store and process guest information on your behalf and only on your instructions, except for the limited purposes described in the Privacy Policy, such as security and complying with the law.
- Guest photos, cards and answers on our servers are deleted automatically after 90 days from the event date, usually within a day or two after that. Download anything you need to keep before then. You are responsible for any copies you download or keep.
11. Suspension and termination
- You can stop using the Service at any time and ask us to close your account by emailing larson_e@ymail.com.
- We may suspend or end your access if you break these Terms, if your use creates a risk for guests, other users or us, or if the law requires it. Where it is reasonable, we will tell you first and give you a chance to fix the problem.
- When an account is closed, guest information is deleted on the schedule in the Privacy Policy, and your account information is deleted within a reasonable time unless the law requires us to keep some of it.
- Sections that by their nature should continue after these Terms end will continue, including Ownership, Disclaimers, Limitation of liability, Indemnity and Governing law.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE.
PRINTED RESULTS DEPEND ON YOUR PRINTER, PAPER, SETTINGS AND EQUIPMENT, AND WE DO NOT GUARANTEE HOW PRINTED CARDS WILL LOOK. WE ARE NOT RESPONSIBLE FOR OUTAGES OR PROBLEMS CAUSED BY THIRD PARTIES, SUCH AS HOSTING PROVIDERS, INTERNET SERVICE OR DEVICE MAKERS.
13. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF WE WERE TOLD THEY WERE POSSIBLE.
TO THE FULLEST EXTENT THE LAW ALLOWS, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF THE FEES YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR US $100.
14. Indemnity
You will defend and indemnify Trading Card Photo Booth against any claims, damages, losses and costs, including reasonable attorneys' fees, arising from Your Content, your use of the Service or your events, your breach of these Terms, or your failure to give notice to or obtain consent from guests or their parents or guardians as the law requires.
15. Governing law and where disputes are decided
These Terms are governed by the laws of the State of Texas and applicable United States federal law, without regard to conflict-of-law rules. Any dispute arising out of or related to these Terms or the Service will be decided only in the state or federal courts located in Texas, and you and we agree to the jurisdiction of those courts.
16. Changes to these Terms
We may update these Terms from time to time. We will post the new version on this page with a new "Last updated" date, and we will notify Operators (for example by email or a notice in the Service) before material changes take effect. If you keep using the Service after changes take effect, you accept the updated Terms.
17. General
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Service, unless we have signed a separate written agreement with you.
- Severability. If any part of these Terms cannot be enforced, the rest stays in effect.
- No waiver. If we do not enforce a part of these Terms, we have not given up the right to enforce it later.
- Assignment. You may not transfer these Terms without our written consent. We may transfer them as part of a merger, acquisition or sale of assets.
- Notices. We may send notices to the email address on your account. You can send notices to us at larson_e@ymail.com.

- You may use the booth to make your trading card for your own personal use.
- The booth company running the event decides what the card looks like and which questions you are asked.
- Your photos are used to make your card. We do not use them for advertising or to train artificial intelligence.
